By using the site and subscribing to www.artsphere.co.uk you accept and agree to the following terms and conditions. If you do not agree to these terms and conditions do not use www.artsphere.co.uk.

The following terms and conditions of use (‘terms’) govern your (‘you’) use of the www.artsphere.co.uk web site (‘Site’), as provided by Artsphere Ltd (‘Artsphere Ltd’ or ‘Artsphere’ or ‘we’).

The www.artsphere.co.uk website is made available to you by Artsphere, a limited company incorporated in England and Wales (Registration Number 5470444) with its registered office at 46 Glenmore Drive, Kings Norton, Birmingham, United Kingdom.

Artsphere Ltd may change these conditions at any time without any notice to you. Please check these conditions from time to time for any changes. By continuing to use the Site you are deemed to have agreed to all updates to these conditions.

Permitted Use of the Site

You may not use the Site for any illegal purpose or operation which is unlawful under the laws of the United Kingdom or any other jurisdiction from which access is made. This includes any purpose or operation which is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another’s privacy, or is (in Artsphere Ltd’s reasonable opinion) otherwise objectionable.

You may not use the Site to create, verify or update your own databases, records, directories, customer lists or mailing lists or those of third parties.

In order to sign up to the Site and/or create a Standard and/or Premium Listing you must be either a person of 18 years or over, resident in the UK, or a business or charity registered and trading/working within the UK.

Administration information

In the course of signing up and using the site you will be required to provide certain administration information about yourself. You acknowledge and agree that the information you provide is accurate. We agree that this information will be used for administrative purposes only.

Performer Information

In the course of signup up you will be required to provide information pertaining to you as a performer / group performer. You acknowledge and agree that the information you provide is accurate and you undertake to keep such information up to date.

Unless otherwise expressly stated, copyright, database right or similar rights in all material presented on the Site, (including graphical images, text, video clips, reprographics, sounds, demos, patches and other files) is owned, controlled or licensed by Artsphere Ltd or its affiliates and is protected or covered by copyright, trade mark, intellectual property law and other proprietary rights.

You have limited permission to display, print or download extracts from these pages for your personal non-commercial and non-profit use only and you shall not be entitled to commercialise any such material in any way.

Any copies of the pages of the Site which you save to disk or to any other storage system or medium may only be used for subsequent viewing purposes or to print extracts for personal use.

You may not (whether directly or indirectly including through the use of any program) create a database in an electronic or other form by downloading and storing all or any part of the pages from the Site without our prior written consent save as expressly authorised by an agreement in writing between us.

Unless with our prior permission no part of the Site may be reproduced or transmitted to or stored in any other web site, nor may any of its pages or part thereof be disseminated in any electronic or non electronic form, nor included in any public or private electronic retrieval system or service.

You may not amend, republish, distribute, reproduce, adapt or modify any of the materials on the Site or use any of the materials for public performance or otherwise make commercial use of the Site or any materials located on it without our prior written consent.

Nothing on the Site or your use of any of the services shall be construed as conferring any licence or other rights under the intellectual property or other proprietary rights of the owners and operators of Artsphere Ltd, www.artsphere.co.uk its affiliates or any third party, whether implied or otherwise, save as expressly provided.

Confidentiality

If you use the Site, you are responsible for maintaining the confidentiality of your user details and any password provided, and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your user details or password.

Linking to Artsphere Ltd

We welcome links to the Site from external sites, and you may use our logo / information as stipulated in the “Linking to Artsphere Ltd” page but we request that you always link to www.Artsphere.co.uk and not any specific page.

Images / buttons are available to download from the Site for the specific use of linking to the Site, publishing in company literature and/or emails. Any unauthorised use of the images and/or Artsphere Ltd logo shall be deemed a breach of copyright.

Under no circumstances shall you use any meta-tags or any other "hidden text" utilising the Site or Artsphere Ltd’s name or trademarks without the express prior written consent of Artsphere Ltd. You also agree not use any of the Site or Artsphere Ltd’s logo or other proprietary graphic or trademark as part of the link without express written permission, except as laid out above.

Fees / payments

No fees will be charged for viewing the Site or any part thereof, although viewing of restricted pages will require free registration.

The latest signup fee for Premium Members will be published on the Site and supersedes any previous fees on any print literature or any other publication.

The terms 'Lifetime Membership', ‘Standard Listing’ and ‘Premium Listing’ shall be limited to the following terms:

    * Membership of the Directories will not be upheld should Artsphere Ltd cease to exist.
    * Membership of the Directories will terminate should the Individual in question pass away.
    * Membership of the Directories will terminate should the business or organisation in question cease to exist.
    * Membership of the Directory is not transferable from one individual to another, nor shall it be transferable to any new incarnation of a previous ensemble, business or organisation. In such an instance, another directory entry will be required at the current fee rate.
    * Membership of the Directory will be cancelled should you in any way break or abuse these terms. Also see 'Termination' further down these terms.

You shall pay all applicable VAT and other taxes relating to use of the Site.

Termination

You may terminate your usage or access to the Site at any time. In the event of registration or subscription to any Service, you may terminate such subscription or registration at any time in accordance with or subject to agreed terms by sending an e-mail via the contact form.

Upon termination, you may receive an automated confirmation via e-mail that the request was received, and your subscription or registration will be suspended as soon as reasonably practicable. If you terminate your subscription part way through your subscription ‘term’ you will not be entitled to a part or full refund.

All discounts are only available during the time in which you are a Premium Member and will revert back to published standard prices if your Premium Listing is terminated for any reason. This is applicable to any long term advertisements, web hosting, web design, or any other service or product you may buy or agree to buy from us.

We may, at our sole discretion, at any time terminate or suspend your access to all or part of the Site without reason.

We will confirm the relevant terms of or grounds for termination.

You use the Site at your own risk.

This Site and all related services are provided on an ‘as available’ basis and Artsphere Ltd provide no guarantee or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials or products included on this Site. Artsphere Ltd does not guarantee the accuracy of the content of the Site. The views of subscribers do not necessarily represent those of Artsphere Ltd.

Whilst we make every effort to maintain a virus-free system, we do not warrant that this Site, its servers, or emails sent from the Site are free of viruses or other harmful or malicious components. We will not be liable for any losses or damages of any kind arising from the use of the Site.

You acknowledge that the Internet or our systems, servers, and equipment may from time to time be inoperative in full or in part as a consequence of but not limited to mechanical breakdown, power failure, maintenance, hardware or software upgrades, telecommunication connectivity problems or other factors beyond our control. We will not be liable for any failure or inability to provide continuous, error free, uninterrupted services under these or any other circumstances.

We are in no way responsible for the content of any web sites or pages accessed through external links from the Site. The views represented in these sites do not necessarily represent the views of Artsphere Ltd. Whilst we make every attempt to ensure that individuals, organisations and businesses featured on this site and in the directory are experienced professionals, Artsphere Ltd are in no way responsible for the quality of services or products they may provide. We therefore recommend that references, and, if necessary, Criminal Record Bureau checks are sought and verified before entering into any agreement with any individuals, organisations or businesses.

We reserve the right to change the content of the Site at any time.

Liability Limitation

Artsphere Ltd and it’s employees or any other party involved in the creation, production, maintenance or distribution of the Site, shall not be liable, under any circumstances, for any of the following: loss of profits; loss of business or business opportunities; loss of anticipated savings; loss of goodwill; loss of use of data; loss of data; other intangible losses; or any indirect, incidental, special or consequential loss or damages whether based on breach of contract, tort (including negligence), product liability or otherwise, which results from:

   1. the use of and/or reliance on the Site;
   2. the inability to use the Site;
